HOW TO TRANSIT FROM A SUBCLASS 457/482 TO PERMANENT RESIDENCY (PR) IN AUSTRALIA

From March 2018, the Australian Government abolished the Temporary Skilled 457 visa and introduced 482 Visa. This substantially changes the process for an applicant to transit from 457 to PR.  

THERE ARE FOUR MAIN PATHWAYS TO TRANSIT FROM 457 TO PR 

A: 457 TO ENS/RSMS (TRANSIT STREAM) REQUIREMENTS:

This is the common option for temporary 457 visa holder (applicants who held or applied for their 457 Visa before 18th of April 2017).

After 2 years on a 457 working visa, visa holders may apply for residency.

  • You have been working with the same employer in position for the last 2 years (exemptions may apply).
  • Under 50 years
  • Meet the required IELTS score. (Competent English- IELTS 6.0 or comparable)
  • Meet the health, character and age requirements

B: 457 TO ENS (DIRECT ENTRY) STREAM REQUIREMENTS

You may apply for ENS /RSMS under this stream directly if:

  • you have a positive skill assessment
  •  have 3 years of working experience based on your profession.
  • Meet the required English Language requirement (IELTS 6 or comparable).
  • Under 45 years

C: SKILLED MIGRATION (189/190/491)

General Skilled Migration (GSM visas – 189/190/491) are other options to apply for PR. There is no need for a company/employer to sponsor you for this visa. You need to score at least 65 points on a Points-tested system, based on your level of education, age, years of working experience, English proficiency, etc.

You must first submit for an Expression of Interest (EOI) and be invited by the State.

D: PARTNER VISA (820)

If you are married or in a de facto relationship with  an Australian PR or citizen partner and your relationship can be established as genuine and on-going, you may apply for a Partner Visa.
